DOT Releases Notice of Proposed Rulemaking |
The Department of Transportation released a notice of proposed rulemaking "Procedures for Transportation Workplace Drug and Alcohol Testing Programs." The document is "designed to align DOT regulated-industry drug testing with the Department of Health and Human Services (HHS) laboratory drug testing requirements. DOT's primary laboratory proposals include: Testing for MDMA (i.e. Ecstasy), lowering cutoff levels for cocaine and amphetamines, conducting mandatory initial testing for heroin and authorizing employers to use HHS-Certified Instrumental Initial Test Facilities to conduct initial drug testing. DOT also proposes bringing a number of their testing definitions in-line with those of HHS."

DATIA's Comments On New CCF |

DATIA recently submitted comments on the Proposed Revisions to the Federal Drug Testing Custody and Control Form. Comments included: suggesting the use of a third label on the CCF for forwarding a sample from an IITF (when that IITF cannot report a result for the specimen) to an HHS laboratory (in lieu of using tamper evident tape to reseal the sample for shipment), including a verification check box for the donor’s identification in Step 1 of the CCF, clarification of whether a DER and/or TPA will be allowed to ask the lab to pre-mark the agency box when printing the CCF forms (Step 1 Part D) and clarification as to whether omitting information in Step 1 Part D of the CCF will result in a flaw. DATIA also inquired as to the transition period for use of the new CCF, asking when the new CCF will be approved and available and since the current CCF has been approved through 2012 – if companies that are not using an IITF will be able to use the current CCF through that date. DATIA also suggested improving the print quality of the CCF so that all copies will be legible when transmitted via fax and/or scanning. Finally, DATIA advocated for the use of carbonless chain of custody forms where the data can be inputted electronically.
