SAMHSA Releases Corrected Effective Date to Final Notice of Revisions to Mandatory Guidelines
** Please note: The effective date on the published revisions (per today's update - Wednesday, December 10, 2008 - in the Federal Register) is May 1, 2010.

The Substance Abuse and Mental Health Services Administration (SAMHSA) recently published a Final Notice of Revisions to its Mandatory Guidelines for Federal Workplace Drug Testing Programs (Guidelines). The Guidelines establish the scientific and technical guidelines for the Federal workplace drug testing programs and establish standards for certification of laboratories engaged in drug testing for Federal agencies by addressing the collection and testing of urine specimens, the requirements for the certification of Instrumented Initial Test Facilities (IITFs), and the role of and standards for collectors and Medical Review Officers (MROs)...

Court of Appeal Issues Temporary Delay on Direct Observation Requirement
The U.S. Court of Appeal for the D.C. Circuit has temporarily delayed the November 1st Direct Observation (DO) requirement for DOT return-to-duty and follow-up tests. This is an “administrative stay” until the Court completes its review on the matter. Therefore, DO for return-to-duty and follow-up testing will continue to be an employer option, rather than mandatory.
