NHTSA Updates the Conforming Products List for Evidential Breath Testing Devices |
On March 11, 2010, the National Highway Traffic Safety Administration (NHTSA) published a notice in the Federal Register that updates the Conforming Products List (CPL) of instruments that conform to the model specifications for Evidential Breath Testing Devices.
The major changes to the updated CPL list include four new instruments and an update to the mobility status of one existing instrument.
The following four instruments were added to the CPL:
- Alcotest 7510 [manufactured by Draeger Safety Inc., Irving, Texas]
- Alco-Sensor V [manufactured by Intoximeters, Inc. St. Louis, Missouri]
- Evidenzer [manufactured by Nanopuls AB, Uppsala, Sweden]
- Mark V Alcovisor [manufactured by PAS International, Fredericksburg, Virginia]
The following instrument's mobility status was updated to include 'mobile':

DATIA Submits Comments On DOT’s CFR 49 Part 40 NPRM |
|
DATIA submitted its official comments on the DOT’s proposed rule change earlier today. In its comments, DATIA suggested changes to the DOT’s proposals for new definitions, reiterated concerns regarding chain of custody issues when transferring specimens from an IITF to a SAMHSA laboratory, provided comments on what MRO information should be made available to auditors, supported the proposed changes to cutoff levels and drugs to be tested for, and weighed in on the proposed MRO certification process among other items. DATIA encourages ALL DATIA members to submit comments to the DOT on their own letterhead as well. The more comments that the DOT receives, the more likely they will be to follow the recommendations of the industry. DATIA members may feel free to copy DATIA’s comments. DOT Publishes Three Drug And Alcohol Program Final Rules |
1. One rule adopts in total an Interim Final Rule authorizing employers to disclose to State commercial driver licensing (CDL) authorities the drug and alcohol violations of employees who hold CDLs and operate commercial motor vehicles (CMVs), when a State law requires such reporting. This rule also permits third-party administrators (TPAs) to provide the same information to State CDL licensing authorities where State law requires the TPAs to do so for owner-operator CMV drivers with CDLs. Therefore, it represents no change to our current regulations.

2. A second rule updates two important DOT forms – the U.S. DOT Alcohol Testing Form (ATF) and the Management Information System(MIS) Data Collection Form:
· While use of the new ATF is authorized immediately, its use is required by August 1, 2010.
i. Updated Paperwork Reduction act Burden Statement;
ii. New DOT form number;
iii. Addition instructions on the reverse side of page 3; and
iv. Results box text is smaller font and have been moved.
· The new MIS form is authorized for use in 2011 to report calendar year 2010 MIS data.
i. Updated Paperwork Reduction act Burden Statement;
ii. New DOT form number;
iii. MIS instructions changed “RSPA” to "PHMSA.”

3. The third regulation adopts in total an earlier Interim Final Rule’s procedures for using an alcohol screening device. Therefore, it represents no change to our current regulations.

New DATIA Webinars - YOU Could Be A Presenter |
DATIA is seeking qualified presenters to share their experience and expertise with colleagues in he drug and alcohol testing industry, via webinar presentations. To fulfill DATIA's mission of providing high-quality and relevant education to the drug and alcohol testing industry, we are establishing a webinar program that will offer webinars, on average, every other month.
We are looking for a wide variety of presentation topics that will address the varied continuing educational needs of the full spectrum of drug and alcohol testing providers and end-users. We encourage presenter proposed topics as well as persons interested in presenting the webinars that were recommended by DATIA's Standards Committee.

DOT Releases Notice of Proposed Rulemaking |
The Department of Transportation released a notice of proposed rulemaking "Procedures for Transportation Workplace Drug and Alcohol Testing Programs." The document is "designed to align DOT regulated-industry drug testing with the Department of Health and Human Services (HHS) laboratory drug testing requirements. DOT's primary laboratory proposals include: Testing for MDMA (i.e. Ecstasy), lowering cutoff levels for cocaine and amphetamines, conducting mandatory initial testing for heroin and authorizing employers to use HHS-Certified Instrumental Initial Test Facilities to conduct initial drug testing. DOT also proposes bringing a number of their testing definitions in-line with those of HHS."
