Question: Is an MRO assistant allowed to verify a donor's prescription for the MRO? This would entail calling the pharmacy or the donor's physician.
Answer: It was my interpretation of 40.131 and 40.141 that the staff are only permitted to do the initial contact. However, I sent this question to ODAPC and received the following reply from George Ellis:
Their intent [40.131] was to correct past abuses from TPAs and MRO staff circumventing the interview process, whether directed or not, and making it clear the qualified physician had to conduct the actual interview.
Once the interview has been conducted, they (DOT) have no objection to staff under direct supervision of the MRO, verifying the medical information given to the MRO. This would include but is not limited to, prescription and medical/dental procedure verification.
Once the verification has been completed, the information must still be reviewed by the MRO for purposes of making a final MRO determination.
