The Department of Transportation Issues an Interim Final Rule Regarding Specimen Validity Testing

Recently, DATIA sent out a regulatory alert notifying drug and alcohol testing professionals of an interim final rule issued by The Department of Transportation (DOT) on November 9, 2004. This rule amends drug and alcohol testing procedures for laboratories and medical review officers (MRO), making DOT requirements for specimen validity testing (SVT) consistent with the Department of Health and Human Services’ (HHS) new guidelines on SVT that became effective November 1, 2004.

This new rule is effective November 9, 2004, but comments may be filed by December 9, 2004.

The Federal Aviation Administration (FAA) has Announced Their Random Drug Testing Rates for 2005

The FAA has become the leader of the pack by being the first mode to announce their Federal random drug testing rates for 2005.

Their 2005 percentage rates for alcohol testing and controlled substance testing have not changed. Click here to view the announcement.

Question: We have one client that falls under the Research and Special Programs Administration (RSPA). This program is different from some other modes, in that, it requires a written anti-drug plan. What criteria must be contained in this policy?

Answer: Section 199.101a(1-4) of RSPA's 49 CFR PART 199 drug and alcohol testing guidelines states that " Each operator shall maintain and follow a written anti-drug plan that conforms to the requirements of this part and the DOT procedures. This plan must contain-
(1) Methods and procedures for compliance with all the requirements of this part,including the employee assistance program;
(2) The name and address of each laboratory that analyzes the specimens collected for drug testing;
(3) The name and address of the operator's medical review officer; and
(4) Procedures for notifying employees of the coverage and provisions of the plan."
