A New California Bill Threatens Student Drug Testing in the State

On May 28, 2004, the California Senate approved a bill titled SB 1386 (sponsored by Senator John Vasconcellos, D-Santa Clara). If approved by the House and signed into law by California Governor Arnold Swarznegger, this proposed bill would ban random student drug testing in all California state public schools.

According to this bill, reasonable suspicion testing would be acceptable, under the condition that the suspicion is based on "articulable facts." The bill also requires that before a test is ordered for a student, there must be written consent from the student's parent or guardian. View the complete text of SB 1386 in PDF format.

As you can see, this bill will have a tremendous impact on the future of student drug testing in California. The Assembly Education Committee will hear the bill on June 16, 2004. All California members who oppose this bill should contact their committee representative no later than June 11, 2004, to voice opposition to SB 1386. Question: Will DATIA host the Alternative Specimen and Onsite Testing-Making it Work for You Workshop in any other cities this year?

Answer: The workshop is a one-time only event. DATIA hosts a July workshop every year in Washington D.C. The purpose of these workshops is to address and focus on one key issue effecting the drug and alcohol testing industry during that particular year. This year, it is alternative specimen testing and the newly proposed alternative specimen testing guidelines that were intoduced by HHS in April.
